Bernard Fearing appeals the judgment of conviction and sentence imposed after he entered a plea of no contest to delivery of tetrahydrocannabinol, THC, contrary to Wis. Stat. § 961.41(1)(h)1 (1997-98). The court withheld sentence and placed Fearing on probation for a period not to exceed thirty months with a number of conditions, one of which was that he serve six months in the county jail with work release privileges but without good time. The court then stayed three months of that six month period of confinement and stated that the three months stayed "[could] be imposed at the discretion of [Fearings] agent, if he or she deems it appropriate."
